Internal Affairs investigations are subject to the Personal Information Protection and Electronic Documents Act, S.C. (PIPEDA) which came into force on January 1, 2004.
The PIPEDA defines when an organization may collect, use and disclose personal information without the knowledge or consent of an identifiable individual. Disclosure of personal information about an identifiable individual without the knowledge or consent of an identifiable individual is prohibited except as permitted and defined by the Act and related Regulations. One of the exceptions to this prohibition is the disclosure of personal information to an 'Investigative Body' if the investigative body is defined in Regulations made under PIPEDA. Internal Affairs qualifies as an 'Investigative Body' as defined by Section 1 of the Regulations made under that Act with respect to the collection, use and disclosure of personal information. Internal Affairs, as required by the Act, has and subscribes to a Privacy Code that is compliant with the Canadian Standards Association Standard CAN/CSA-Q830-96 Model Code for the Protection of Personal Information and is a member in good standing of the Council of Private Investigators - Ontario (C.P.I.O.), a professional association in the Province of Ontario that also has such a privacy code. Internal Affairs does not and will not disclose personal information about a client to any person or agency without first obtaining the consent of the client as required by the PIPEDA or other applicable provincial privacy legislation unless ordered to do so by a court of competent jurisdiction or other legal process. Moreover, S. 24 of the Private Investigators and Security Guards Act, Ontario states that, "No person shall divulge to anyone, except as is legally authorized or required, any information acquired by him or her as a private investigator."
